Who is Covered Under Safeways’ Workers’ Compensation?*

Safeways, as a large supermarket chain, employs a variety of workers, such as butchers, bakers, cleaners, cashiers and warehouse workers. All these jobs at times have their risks, such as slips and falls on ragged floor covering or a spilt liquid, to head injuries from packages falling from a high shelf. Fortunately, in most cases of injury and whether the accident was caused by an obstruction that should not have been there or by the worker workers’ compensation should still be available as long as the Safeway employee has to take time off work to recover.

Who is Covered Under Safeways’ Workers’ Compensation?

Typically, each state is responsible for its worker’s compensation laws but most states except Texas have clear no fault workers’ comp. laws that favor the employee. Apart from requiring that employers who have at least one employee must carry insurance for workers’ compensation, employers are required to cover full time, part time and temporary workers too. There is some variation between states as to the minimum of workers employed before workers’ compensation coverage becomes compulsory. If the Safeways worker pays tax deducted from wages then he or she would normally be eligible to file a claim for workers’ compensation.

Who is not Covered Under Safeways’ Workers’ Compensation?

Workers’ compensation is a no fault benefit, so whether the accident was your fault or not you should still be entitled to file a claim. If you were drunk at the time of the accident which caused your accident and subsequent injury you may find that Safeways will not accept a WC claim from you. Additionally, if you had an accident in your auto on the way to work you will not be covered by Safeway’s workers’ comp.

Who is Covered Under Safeways’ Workers’ Compensation?*

There are some people who may work on Safeways’ premises who are not eligible to file a workers’ compensation claim. These include independent contractors brought in from outside to do a job, such as gardening, widow cleaning and food delivery. Depending on whether they are self employed, or if they work for a contractor, someone will be responsible for providing workers’ comp. coverage, but not Safeways.
